Damages

Damages for personal injury are divided in to two categories, General Damages, and Special Damages. General Damages are the damages for the injury itself, and the pain and suffering it may cause. Special Damages are the items of monetary loss stemming from the accident/injury, both past and future e.g loss of earnings, damage to property, and the cost of extra care.

In more serious cases were the injured person cannot return to work, or requires long term nursing care, the bulk of any award will be Special Damages.

The following figures relate only to possible awards for the injury itself (General Damages)

These figures are intended as rough guide only since much will depend on the individual circumstances of the case.

1. Head Injuries

A. Brain Damage
Very Severe Brain Damage £155,000 to £220,000.
Moderate Brain Damage £82,000 to £120,000.
Minor Brain Damage £8,500 to £23,000.

B. Minor Head Injury £1250 to £7,000.

2. Psychiatric Injury

Severe £30,000 to £63,000.
Moderate to Moderately Severe £3,250 to £30,000
Minor £800 to £3,250.

3. Whiplash

A. Neck
# Severe £7,500 to £13,750
Moderate £4,250 to £7,750
Minor £750 to £4,250.

B. Back
Severe £6,750 to £15,250.
Minor £750.00 up to £7,500.

4. Knee Injuries

Severe £17,500 to £27,500.
Moderate to Minor Injuries £1,000 to £7,500.

5. Ankle Injuries

N.B. The vast majority of ankle injuries are worth significantly less than £10,000.
Severe £17,500 to £27,500.
Moderate £7,250 to £14,750.
Modest £750 to £7,500.

6. Wrist

Severe £13,500 to £21,500.
An uncomplicated fracture will be worth in the region of £4,000.
Minor fractures were there is a full recovery £2,000 to £2,500.
